Article 3.(Provision of Personal Information to Third Parties)
AUCNET will not provide personal information to third parties without the prior consent of the User, except in the following cases or as permitted by the Personal Information Protection Law and other laws and regulations:
(1) When it is necessary to protect a person's life, body, or property, and it is difficult to obtain the User's consent.
(2) When it is especially necessary to improve public health or promote the sound growth of children, and it is difficult to obtain the User's consent.
(3) When it is necessary to cooperate with a national institution, local public body, or an entity entrusted by them in executing the affairs prescribed by law, and obtaining the User's consent may hinder the execution of such affairs.
(4) When the following matters have been notified or publicly announced in advance:
- Including the provision of personal information to third parties in the purpose of use.
- Items of data provided to third parties.
- Means or methods of provision to third parties.
- Stopping the provision of personal information to third parties upon the User's request.
Notwithstanding the provisions of the preceding paragraph, the following cases do not fall under the category of providing information to third parties:
(1) When AUCNET entrusts all or part of the handling of personal information within the scope necessary to achieve the purpose of use.
(2) When personal information is provided as part of the succession of business due to a merger or other reasons.
(3) When personal information is jointly used with a specific party, and the User has been notified in advance or placed in a readily accessible state about the joint use, the items of personal information to be jointly used, the scope of those who jointly use the information, the purpose of use by those who use the information, and the name or title of the person responsible for managing the personal information.
Article 4(Disclosure of Personal Information)
AUCNET will disclose personal information to the Users without delay upon their request. However, AUCNET may choose not to disclose all or part of the information if any of the following conditions apply. In the event that AUCNET decides not to disclose the information, AUCNET will promptly notify the Users of this decision.
Additionally, Users must request the disclosure of personal information using the form specified by AUCNET.
(1) If there is a risk of harm to the life, body, property, or other rights and interests of the Users or a third party.
(2) If there is a risk of significant hindrance to the proper execution of AUCNET's business operations.
(3) If disclosure would result in a violation of laws and regulations.
Article 5(Transfer of Personal Information to Third Countries)
AUCNET will not transfer the personal information of Users to third countries without the prior consent of the Users.
Article 6(Retention Period of Personal Information)
AUCNET will retain Users' personal information only for the period necessary to achieve the purpose of use of the Service.
Except when it is necessary to retain the personal information for a period exceeding the respective purpose of use, AUCNET will store the personal information only for the duration necessary for the use specified above.
Article 7(Protection of Personal Information)
AUCNET will take reasonable technical measures to protect Users' personal information to ensure its security.
Article 8(Correction and Deletion of Personal Information)
Users may request AUCNET to correct or delete their personal information if they find that the information about themselves held by AUCNET is incorrect, in accordance with the procedures specified by AUCNET.
If AUCNET determines that it is necessary to comply with the User's request received in the preceding paragraph, AUCNET will promptly correct or delete the relevant personal information and notify the User accordingly.
Article 9(Suspension of Use, etc., of Personal Information)
If a User requests AUCNET to suspend or delete the use (hereinafter referred to as "Suspension of Use, etc.") of their personal information on the grounds that it is being handled beyond the scope of the intended purpose or that it was acquired through illegitimate means, AUCNET will promptly conduct necessary investigations based on the results of which it will suspend the Use, etc., of the personal information and notify the User accordingly.
Article 10(Changes to Privacy Policy)
AUCNET may change the Privacy Policy as necessary.
When AUCNET changes the Privacy Policy, it will notify Users of the effective date and content of the revised Privacy Policy through appropriate methods such as posting on the Internet or other suitable means, or directly notifying Users.
